You’ve probably heard something about the Employee Retention Tax Credit by now. Also known as the ERC or ERTC, the tax credit is being advertised on the internet, television, radio, and more.

But these ads about the ERC don’t always make it clear how to apply, or whether you can still claim the ERC tax credit retroactively for tax quarters in 2020 and 2021. Fortunately for you, there are tax professionals particularly skilled in dealing with the ERC at Dayes Law Firm, and we are happy to answer any questions you may have about the tax credit.

Is the ERC Still Available?

There are deadlines for the ERC coming up, but the tax credit is still available for business owners interested in claiming it.

The ERC is a fully refundable tax credit initially introduced as part of the Coronavirus Aid, Relief, and Economic Security (CARES) Act in March 2020. It was later extended and expanded through other legislation.

But you can only claim the tax credit for certain eligible periods. The ERTC is available to qualified employers for wages paid from March 13, 2020, through December 31, 2021. It is “for businesses that continued to pay employees while shut down due to the COVID-19 pandemic or had significant declines in gross receipts” during those early months of the pandemic, according to the IRS.

Can You Still Claim the ERC Tax Credit?

Yes! There is still time to claim the ERC tax credit retroactively.

The ERC can be claimed for quarterly payroll tax filings from 2020 and 2021 and is not available for filings from 2022. Obviously, those years have passed, but businesses can claim the ERtC tax credit using an amended tax form.

As a business owner, you can file an amended Form 941X (Quarterly Federal Payroll Tax Return) to claim the ERC for past tax quarters. If you are unsure whether you’re eligible to apply, you can reach out to a tax professional or attorney like those at Dayes Law Firm for assistance.
