What Documentation Do Businesses Need to Apply for the ERTC?

There is certain documentation that all businesses need to include when applying for the Employee Retention Tax Credit, also known as the ERTC/ERC. A team of tax professionals, like the team at Dayes Law Firm, can assist you in compiling this information if you don’t want to pursue claiming the credit on your own, and they may even help you catch vital pieces of information you don’t want to be missing from your application when it goes to the IRS.

Documentation Businesses Need to Demonstrate Eligibility for the ERTC

As a business owner, you’ve got enough to worry about without also worrying about complications with your ERTC application like the threat of an IRS audit. Including all of the necessary documentation in your application to prove your eligibility can help avoid this, but it’s a lot of information to track down and keep organized.

The first document you’ll need to apply for the ERTC is an amended Form 941X (Quarterly Federal Payroll Tax Return). But that form will also need to be accompanied by other documentation to support your claim.

You may need to include a Profit and Loss sheet for each quarter of 2019, 2020, and 2021 to apply for the ERTC and defend your claim. You will probably also need payroll summary reports and related documentation regarding the number of employees you have/had at the time on payroll, their gross wages, and what type of employee they are – full-time equivalent versus part-time staff.

As an employer, you may also need a written form of attestation or letter to prove that you have met all the ERTC eligibility criteria and, if you applied for a Payroll Protection Program loan, you might also need to produce PPP loan documents. That could include a forgiveness application if applicable. A tax attorney can help you with these particulars if you’re unsure of exactly what to add as documentation to demonstrate eligibility for the ERTC.
