If I Am Injured, Do I Qualify for SSI or SSDI?

It depends.

Any injury that leads to a disability that lasts more than one year is often sufficient to get your application approved. However, it is important to understand that short-term disability benefits can be covered by workers compensation benefits or insurance. In these cases, an SSDI benefit may not be available.

In order to determine whether you qualify for SSI & SSDI benefits the SSA will ask five questions:

  1. Are you working?
  2. Are you severely injured or disabled?
  3. Is your injury or disability listed on the SSA master list?
  4. Can you go back to your old job or work?
  5. Are there are types of work that you can do?

But the key question is whether your disability or injury qualifies you for SSDI benefits. Disability is determined by your ability to work and earn an income. An injury does not have to disable you permanently in order for you to receive SSDI benefits.

SSI & SSDI Injuries

The Social Security Administration (SSA) has an extensive and complicated list of medical conditions and injuries that determine whether an individual qualifies for Supplemental Security Income (SSI) or Social Security Disability Insurance (SSDI).

Only an experienced SSDI lawyer who is familiar with all of the facts of your case can advise you on whether your specific injuries and disabilities meet the SSA requirements.

In general, there are several categories of disability that may qualify you for SSDI benefits, including:

  • Blindness
  • Speech diseases
  • Mental illnesses
  • Cardiovascular diseases
  • Immune system diseases
  • Cancer
  • Muscular diseases
  • Blood-related diseases
  • Back, hip and neck injuries
  • Traumatic Brain Injuries

Regardless of your specific type of injury and disability, the process of establishing that your injury or disability is severe enough to meet the requirements is complicated. The SSA will require medical assessments and extensive documentation.

When you are concerned about whether your specific injury will allow you to get disability benefits, pick up the phone and call a disability lawyer. The Dayes Law Firm PC team can answer all of your disability-related questions.
