How to Get Disability Benefits for Hepatitis C

Hepatitis C is a serious viral disease that causes liver inflammation. It can be contracted in a number of different ways, including from blood transfusions prior to 1992, regular contact with blood at work, kidney dialysis, acupuncture, tattoos and even sharing toothbrushes with another person who has it.

Most people do not experience any symptoms after first contracting Hepatitis C. However, a majority will eventually develop a chronic HCV infection, which can present symptoms such as jaundice, severe liver damage, stomach or esophageal bleeding, fever, nausea, stomach pain, vomiting, fatigue, cirrhosis of the liver, appetite loss, and even death.

Although many people who suffer from Hepatitis C are able to continue working, others face severe symptoms that prevent them from maintaining work. These individuals may qualify for Social Security Disability (SSD) benefits if they meet the Social Security Administration’s (SSA) requirements.

Qualifying for Benefits

Hepatitis C is covered in the Social Security Administration’s Blue Book of disabilities in the listing for chronic liver disease in Section 5.0. To meet the requirements of this listing, you will have to provide medical evidence of a diagnosis of chronic liver disease and one of the following complications:

  • Hepatopulmonary syndrome
  • Hepatorenal syndrome
  • Gastrointestinal hemorrhage
  • Spontaneous bacterial peritonitis
  • Fluid in the pleural cavity
  • Excess fluid in the peritoneal cavity
  • End-stage liver disease

If you do not meet this listing, you will have to prove your condition prevents you from working and supply supporting medical documentation such as lab reports of your HCV viral load. You will also need statements from your doctors as evidence.

Your application will be reviewed by an adjudicator who will analyze your application and accompanying forms. You can make it easier for the person reviewing your claim to understand how Hepatitis C impacts your ability to work by including specific details about your medical condition.

If you are considering filing an appeal or applying for benefits for Hepatitis C, a Social Security Disability benefits attorney can work on your behalf to ensure you have the appropriate medical documentation and meet deadlines. A skilled attorney can be an important ally and increase the odds you will receive benefits.

Begin today by contacting the experienced disability attorneys at Dayes Law Firm PC. You will receive a free claim review.
