Employee Retention Credit Deadlines Business Owners Should Know

The Employee Retention Tax Credit, also known as the ERTC or ERC, is still available to many employers if they are eligible to claim the credit for their business. But when are the Employee Retention Credit deadlines? There is a deadline approaching now, and another not far off that all business owners that are eligible to apply for the ERC need to know.

ERC Period – Did the Tax Credit End?

The ERC tax credit can be claimed on qualified wages paid to employees if an employer kept staff on payroll despite significant financial impact during the height of the COVID-19 pandemic. The tax credit is for quarterly payroll tax filings from 2020 and 2021, but can still be claimed retroactively. 

Technically speaking, the Infrastructure Investment and Jobs Act retroactively ended the Employee Retention Tax Credit as of September 30, 2021. But business owners still have time to file to receive Employee Retention Tax Credit refunds claimed via an amended payroll tax return, Form 941-X, for qualifying quarters in 2020 and 2021.

You and your business could qualify for the ERTC and could receive up to $26,000 per employee, so it’s important to determine whether you’re eligible as soon as possible. 

Employee Retention Credit Deadlines

Because there are two different tax years involved when it comes to the ERC, there are two different Employee Retention Credit deadlines you need to have on your radar if you’re a business owner looking to take advantage of this tax credit. 

For the year 2020, quarters two, three, and four qualify to be considered for ERC claim purposes. As for 2021, quarters one, two, and three qualify, and recovery startup businesses may also qualify for the last quarter of 2021.

Those ERTC applications need to be made by the following Employee Retention Credit deadline dates:

  • For all quarters in 2020, the deadline to apply for the ERC is April 15, 2024.
  • For all quarters in 2021, the deadline is April 15, 2025. 

That means employers still have time to take a look at their payroll tax filings for those quarters and determine if wages paid after March 12, 2020, through the end of the program are eligible and, if so, to work on applying for the tax credit ASAP.
