SSD Denial: Why You Should Hire a Disability Benefits Attorney to Help You Appeal

If you have been denied Social Security Disability (SSD) benefits, you have the option to appeal the decision through reconsideration. This is the first level of the appeals process and it allows your application to be reviewed by a different disability claims examiner.

You are welcome to file for a reconsideration on your own, however it is recommended that you have a reputable attorney by your side because this process can be complex and overwhelming.

Our attorneys can review your application to identify any errors or omissions that may have led to your denial. We can then help you gather all of the necessary paperwork and submit a complete and accurate claim on time.

Unfortunately, it is likely that your application will be denied at this level if you were already denied once. Even though a different examiner will look at your application, it is likely that they will come to the same conclusion as the previous examiner.

In this case, you will then move to the next level of the appeals process, a hearing before an administrative law judge, at which point you will absolutely need a lawyer in order to be successful in your appeal.

The Importance of SSD Deadlines

One of the most valuable reasons for having legal counsel throughout the disability benefits appeals process is because of the many tight deadlines you will encounter. Applicants have 60 days from a denial date, plus five grace days for mailing, to submit the paperwork requesting a reconsideration.

Many applicants procrastinate and believe the appeal only needs be postmarked within 60 days. This is not true as the paperwork needs to be physically at the Social Security office on the 60th day.

Disability attorneys are aware of existing deadlines, what documentation is necessary and the procedural aspects of filing an appeal. We can make sure that your paperwork is submitted accurately and on time.

It is wise to consider an attorney to represent you before you begin the process of an appeal. Your attorney will need enough time to act on your behalf, complete necessary paperwork and more. If you wait too long to hire a representative, you might have to file an appeal yourself. Plan ahead and contact a disability attorney right away.
