How to Receive Disability Benefits for Mesothelioma

Mesothelioma is a severe form of cancer that affects the lungs. Those suffering from this disease should be able to receive Social Security Disability (SSD) benefits at a faster approval rate than for other types of disability.

While most disabling diseases are listed in the Social Security Administration’s Blue Book of Impairments and are not expected to improve within 12 months, certain types of mesothelioma are so disabling they are also recognized as Compassionate Allowances Conditions.

This list of conditions is acknowledged by the Social Security Administration (SSA) as containing disabling diseases that meet almost always disability benefits requirements, which allows for expedited approval of benefits.

Severe Forms of Mesothelioma

Two types of mesothelioma are included on the Compassionate Allowances list: pleural mesothelioma and peritoneal mesothelioma. Both types of cancer are severe and rare.

Pleural mesothelioma occurs in the lining of the lungs while peritoneal mesothelioma occurs in the abdomen. Both forms are caused by exposure to asbestos and there is no known cure for the disease. Therefore, applicants with these conditions who apply for SSD will likely receive benefits.

Applicants must ensure that the Social Security Administration (SSA) knows that their condition is listed as a Compassionate Allowance. Include this information on the SSD application so evaluators handling your claim will realize your condition falls on this list.

Other Ways to Qualify for Mesothelioma Benefits

If you have mesothelioma but do not meet the requirements of the Compassionate Allowances list, you could still qualify for disability if you:

  • Had a job that paid into Social Security
  • Are unable to work for at least 12 months because of a medical condition

Along with your application, include medical documentation such as doctor’s notes, bloodwork results and any medical proof outlining why you cannot work.

Filing an appeal or trying to obtain disability benefits can be overwhelming if you are trying to do so yourself. Do not go it alone. Instead, seek out a skilled attorney to advise you and walk you through the application process.

If you or loved one has been diagnosed with mesothelioma are applying for SSD benefits or have been denied benefits, speak to a Social Security disability attorney today. Contact Dayes Law Firm PC for a free case review.
